Extraordinary Remedies

TRO’s, Writs of Attachment, Replevin, Capias; Federal and New Jersey RICO; New Jersey Consumer Fraud Act (CFA)

Alpert Butler & Weiss, P.C. is recognized for its use of extraordinary remedies. For example, the firm is well known for its use, when appropriate, of temporary restraining orders (TRO’s) and preliminary injunctions; Writs of Attachment (creating an involuntary lien against the defendant's assets) or Replevin (for return of property); and Capias (allowing the arrest of the defendant in a civil matter under some circumstances).

The firm is also experienced in evaluating and handling claims under federal and State RICO (or "NJRICO"), New Jersey's Consumer Fraud Act (or "CFA"), and the State and federal False Claims Acts. The latter remedies are important to plaintiffs (and important for defendants to resist) because they afford treble damages as well as an award of attorneys fees, potentially with a fee enhancement under prevailing New Jersey law.
